Interplay Sues BattleBorne

Interplay has filed suit against developer BattleBorne, alleging that the developer improperly terminated an agreement to produce the game Airborne (now known as Combat Elite: WWII Paratroopers, and now being published by Acclaim). The suit alleges breach of contract, and that the developers refused to return a $250,000 advance tendered to BattleBorne for devlopment costs. Acclaim maintains that "Combat Elite is very much the company's property." and they claim the game is still on schedule for a June release. Sounds pretty nasty, so I wouldn't rush out and pre-order the game just yet.
